BOOKING TERMS AND CONDITIONS

OVERVIEW
These Terms and Conditions apply to any tours booked with Barefoot Adventures Pvt. Ltd., an adventure travel company based in Kathmandu, Nepal. These Terms & Conditions govern the contractual relationship between Barefoot Adventures Pvt. Ltd and yourself. Please read these Terms and Conditions carefully as by booking any tour with Barefoot Adventures Pvt. Ltd you acknowledge that you have read, understood, and agreed to be bound by them. If you confirm a booking on behalf of others (including minors or those with disabilities), you are deemed to have accepted these Terms on their behalf. The primary client named in the booking will act as the point of contact for all communication.


1. DEPOSITS & FINAL PAYMENT
A 30% deposit is required to secure a booking. The final balance must be paid no later than 21 days prior to the tour's start date. Bookings within 21 days of the tour start must be paid in full. All payments must be made free of transaction charges.


2. BOOKING AGREEMENT
A booking is confirmed once Barefoot Adventures Pvt. Ltd has received the deposit and sent a written confirmation. The booking client must be 18 years or older and provide accurate and complete information. They must also have the authority to act on behalf of all individuals included in the booking.


3. CANCELLATION POLICY

  • 35+ days before tour start: No cancellation fee

  • 11–34 days before: 30% fee

  • 3–10 days before: 50% fee

  • Within 48 hours: 100% fee
    Tailor-made tours may follow different cancellation terms.


4. TRAVEL INSURANCE
Clients must arrange their own travel insurance from their home country covering medical, evacuation, repatriation, and preferably trip cancellation. The insurer must be made aware of the type of trip to ensure proper coverage.


5. MEDICAL CONDITIONS
Clients must disclose relevant medical conditions and are responsible for determining their fitness for the tour. Medical facilities in remote areas may be limited, and Barefoot Adventures Pvt. Ltd does not guarantee or warrant the availability or quality of such facilities.


6. SPECIAL REQUIREMENTS
Special requests (e.g. dietary needs, specific accommodations) will be considered but are not guaranteed or legally binding.


7. PRICES, SURCHARGES, AND TAXES
Tour prices may change due to external factors (e.g. fuel, accommodation, park fees, taxes, or currency fluctuations) up to 20 days before departure. In such cases, Barefoot Adventures Pvt. Ltd will notify clients, who may:

  • (a) Cancel with a full refund, or

  • (b) Accept the new price.

Clients must respond within 14 days of receiving notice. Discounts offered after confirmation of a booking do not apply retroactively.


8. GUARANTEED DEPARTURES & CANCELLATION BY THE COMPANY
Once at least one client is confirmed, group tour departures are guaranteed, unless impacted by Force Majeure. If Barefoot Adventures Pvt. Ltd cancels a tour for reasons other than Force Majeure or client fault:

  • The client may choose a substitute tour of equal or lesser value (with a refund of the difference if applicable), or

  • Receive a full refund.

No compensation is provided for expenses such as visas, flights, or other non-refundable costs.


9. CANCELLATION OF A TOUR BY THE CLIENT
Clients may transfer their booking to another individual (meeting tour requirements) by notifying Barefoot Adventures Pvt. Ltd at least 14 days in advance. Both the original and new clients are jointly responsible for full payment and any additional costs. Clients on private tours may postpone the tour to a later date, but will be liable for cancellation fees and any additional costs arising due to the delay.


10. CANCELLATIONS AND CHANGES
Adventure travel in Nepal demands flexibility. Changes to routes, accommodation, transportation, and schedules may occur due to illness, weather, strikes, political unrest, or unforeseen events. Barefoot Adventures Pvt. Ltd is not liable for such changes and is not required to offer refunds for missed or unused services resulting from such changes or client negligence.

Alternative accommodations or arrangements will be made where necessary, and clients will be informed of any major changes whenever possible. Decisions made by tour guides regarding changes during a tour are final, especially in situations involving health, safety, or feasibility concerns (e.g. altitude sickness or extreme weather during treks).


11. RISK
The client acknowledges that the nature of our tour products is adventurous and may involve a significant amount of risk to clients’ health and/or safety. There are dangers inherent to adventure travel, and the client accepts these risks by confirming their booking. The client releases Barefoot Adventures Pvt. Ltd from all claims arising from losses, damages, injuries, or death resulting from such risks, including those related to visiting remote areas or engaging in physically demanding or high-altitude activities.

The client further acknowledges that the quality of transport, accommodation, and hygiene in such regions may not meet the standards of their home country. Barefoot Adventures Pvt. Ltd may provide guidance on customs, weather, safety, or legal matters but is not responsible if the client disregards such information.

Failure to follow applicable laws, safety instructions, or behaving in a way that poses a risk or annoyance to others may result in immediate termination of tour arrangements without refund. The client is responsible for costs related to damage or cleaning fees caused during the trip. Clients must take reasonable precautions, use safety equipment where applicable, and follow all instructions from Barefoot Adventures Pvt. Ltd and its third-party suppliers.


12. COMPLAINTS
Clients are encouraged to report any complaints during the tour directly to the head guide or other Barefoot Adventures Pvt. Ltd representative as early as possible to allow timely resolution. Barefoot Adventures Pvt. Ltd assumes no liability for complaints not brought to its attention in a timely manner. Complaints made after the tour must be submitted in writing within 30 days of the tour’s completion.


13. THIRD PARTY SUPPLIERS
Barefoot Adventures Pvt. Ltd works with various third-party service providers (e.g., accommodations, airlines, guides) who may sub-contract parts of the tour. Although selected with care, these providers operate independently, and Barefoot Adventures Pvt. Ltd is not liable for their acts or omissions.

Services are provided under their own terms, which may limit liability. Clients acknowledge that compliance with Nepali laws does not guarantee compliance with laws of other jurisdictions. Barefoot Adventures Pvt. Ltd is not responsible for losses or disappointment caused by third parties.


14. LIABILITY
Barefoot Adventures Pvt. Ltd is not liable for loss, injury, illness, or damages due to a client’s own actions, unforeseeable third-party acts, or force majeure events. Clients are responsible for securing their belongings, and Barefoot Adventures Pvt. Ltd is not liable for lost or stolen items, including at accommodations or in transit.

Liability is limited where applicable by international conventions and does not extend to damages caused by third-party suppliers unless proven negligent.


15. FORCE MAJEURE
Barefoot Adventures Pvt. Ltd is not responsible for failure to perform services due to events beyond its control including, but not limited to, natural disasters, war, terrorism, civil unrest, governmental actions, mechanical failure, labor strikes, or extreme weather.

Such events relieve Barefoot Adventures Pvt. Ltd of all obligations without liability for losses or costs incurred by the client.


16. IMAGES AND MARKETING
By participating in the tours, the client consents to photographs, videos, or recordings taken during the trip that may include their image. Barefoot Adventures Pvt. Ltd reserves the right to use these materials for promotional and marketing purposes in any media without compensation or further consent.


17. AMENDMENTS
Barefoot Adventures Pvt. Ltd reserves the right to amend these Terms and Conditions at any time. Updates will be posted on the official website and take effect 10 days after posting. Continued use of services or participation in tours after this period signifies acceptance of the new terms. Clients are advised to review the Terms and Conditions prior to travel.
